END USER LICENSE AGREEMENT (EULA)
PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE APPLICATION.
This Agreement is a legal contract between you ("you" or "User") and Juggernaut Labs ("we", "us", or "Licensor") for the use of the mobile application ("Licensed Application") made available via the Apple App Store.
By downloading, installing, or using the Licensed Application, you agree to be bound by this Agreement.
1. Acknowledgement
This Agreement is between you and Juggernaut Labs only, not Apple Inc. ("Apple"). Juggernaut Labs is solely responsible for the Licensed Application and its content. This Agreement must not conflict with the Apple Media Services Terms and Conditions or the App Store Review Guidelines.
2. Scope of License
Subject to the terms of this Agreement, Juggernaut Labs grants you a limited, non-exclusive, non-transferable license to use the Licensed Application for personal, non-commercial purposes on any Apple-branded device you own or control, in accordance with the usage rules set forth in Apple's App Store Terms of Service.
3. Maintenance and Support
We are responsible for providing any support and maintenance related to the Licensed Application. Apple has no obligation to provide support or maintenance services for the Licensed Application.
4. Warranty Disclaimer
To the fullest extent permitted by law, the Licensed Application is provided "as is" and "as available" without warranties of any kind. Juggernaut Labs disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Licensed Application.
5. Responsibility for Claims
You acknowledge that Juggernaut Labs, not Apple, is responsible for handling any claims relating to the Licensed Application or your use of it. This includes, to the extent required by applicable law:
- product-related issues,
- claims of non-compliance with applicable legal or regulatory requirements, and
- claims arising under consumer protection or similar laws.
6. Intellectual Property
In the event of a third-party claim that the Licensed Application or your use of it infringes someone else's intellectual property rights, Juggernaut Labs, not Apple, will be responsible for addressing the claim, subject to applicable law and the limitations described in this Agreement.
7. Legal Compliance
You agree to comply with all applicable laws and regulations. You represent that you are not located in a country subject to a U.S. Government embargo or on a U.S. Government list of prohibited or restricted parties.
8. Limitation of Liability
To the fullest extent permitted by law, Juggernaut Labs shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or relating to your use or inability to use the Licensed Application. Our total liability to you for any claims under this Agreement is limited to the amount (if any) you paid for the Licensed Application.

10. Third-Party Terms
You must comply with any applicable third-party terms when using the Licensed Application, such as your wireless provider's terms of service.
11. Third-Party Beneficiary
You and Juggernaut Labs agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
12. Termination
This Agreement is effective until terminated by you or Juggernaut Labs. Your rights will terminate automatically if you fail to comply with any term of this Agreement. Upon termination, you must stop using and delete all copies of the Licensed Application.
